How to Use Revocable Living Trusts to Avoid Probate

McHenry County estate planning attorney Kevin O'Flaherty explains how revocable living trusts can be used to avoid probate.

mchenry county estate planning lawyer

In this article, our McHenry County estate planning attorneys explain how we use revocable living trusts to avoid probate as part of a good estate plan. If you pass away owning any real estate outside of a trust or more than $100,000.00 outside of a trust or payable on death accounts, a probate case will likely be required in order for your loved ones to receive your assets.

We want to avoid probate, because the case takes at least a year, during which time your loved ones will not have access to your assets. Your estate will also have to pay attorney fees and court costs, which can consume a significant amount of your estate.

Our McHenry County estate planning attorneys use revocable living trusts to ensure that when you pass, rather than a time-consuming and costly probate estate, your trustee will be able to distribute your assets to your loved ones immediately without the need for an attorney.
