How Do I Evict a Tenant in Illinois?

In this article, our Illinois landlord-tenant lawyers explain the Illinois eviction process

The first step in an eviction proceeding is to prepare the proper notice of eviction.  The length of the notice depends on the reason for the eviction: 

  • 5 days for failure to pay rent;
  • 10 days for violation of other lease terms; and.
  • 30 days for routine termination of a month-to-month lease

The next step in an eviction proceeding is to properly serve the eviction notice upon the tenant by hand delivery, certified mail return receipt requested, or posting on the door of the premises in question.  

Next, the landlord must file a complaint for eviction in the proper court and  properly serve the complaint upon the tenant.  Finally, the Landlord must appear at the hearing date shown on the summons and prove that he or she followed the proper eviction procedures. If the court enters an order of eviction and the tenant fails to vacate the premises, the Landlord may request that the sheriff remove the tenant.
