Wisconsin Property Division Calculator

This is the total value of all assets you and your spouse acquired during the marriage. Include your house, vehicles, retirement accounts, savings, and anything else of value you both own.

This is the total amount of debt you and your spouse owe together. Include mortgages, credit cards, car loans, student loans, and any other joint debts.

Wisconsin law assumes each spouse gets 50% of the marital property. But if you've agreed to a different split—or a judge decides otherwise—you can change this number.

Estimated Property Division

Wisconsin Property Division

Dividing property in a divorce can be overwhelming. That’s why we created this Wisconsin Property Division Calculator—to give you an idea of how your assets and debts will be divided based on state law.

Wisconsin is a community property state, which means everything acquired during the marriage is usually 50/50. But that’s not always the case. Sometimes the court—or the couple—decides a different split is more fair based on the circumstances.

Let’s go through how the calculator works and how it can help.

What You’ll Need to Use the Calculator

Total Marital Assets
Everything you and your spouse own together that has value. That includes:

  • Your home
  • Vehicles
  • Bank accounts
  • Investments
  • Retirement savings
  • Business interests
  • Personal property like furniture or electronics

Only include property acquired during the marriage. If one spouse owned something before the marriage or received it as a gift or inheritance, it’s separate property and not divided.

Total Marital Debts
The total you and your spouse owe together. Think about:

  • Mortgages
  • Credit card balances
  • Student loans
  • Car loans
  • Personal loans

As with assets, only include debts taken on during the marriage. Debts from before the marriage or in one spouse’s name only might be treated differently.

Party A’s Percentage
Wisconsin law starts with 50% for each spouse. That’s the default in the calculator. But this can change. For example:

  • One person earns way more
  • One spouse stayed home to care for children
  • One spouse wasted or hid assets

You can adjust the percentage to reflect your situation or agreement.

What the Calculator Tells You

Once you enter the numbers, the calculator will give you:

  • Total Net Marital Estate: The total value of your marital property after subtracting debts from assets.
  • Party A’s Share: The dollar amount Party A gets based on the percentage entered.
  • Party B’s Share: The remaining amount, based on what Party A doesn’t get. This is just a starting point. It’s not legal advice and doesn’t account for all the things that might come up in court—like prenuptial agreements or disputes about what’s marital vs. separate property.

Why Use This?

This tool is good if you:

  • Want to know what’s at stake before talking to a lawyer
  • Are planning for a fair divorce settlement
  • Curious what an equal split looks like
  • Want to see if you and your spouse are on the same page financially

It gives you a better idea of what your financial life will look like post-divorce and can help you have more productive conversations with your attorney or spouse.

Why O'Flaherty Law?

Cost-Effective

When we started our firm in the midst of the recession, we learned to survive in a lean environment and pass the savings on to our clients.  As the economy has improved, we have not changed our philosophy.  We are hungry to grow our client base, and so we have intentionally set our rates below what the market will bear.  Our mission is to make each client walk away feeling that they got more value than they paid for.  This is easier to do when we make our prices affordable.

Client-Focused

The secret to our success as a firm is incredibly simple: we build a personal relationship with each of our clients and treat them with the respect that they deserve.  We pride ourselves on our open lines of communication, frequent check-ins with our clients, and our accessibility.  We are here to help you in any way we can, often leveraging our network of resources to assist you with non-legal issues that you may be having.  We are your one-stop problem-solver and trusted adviser.  All attorneys say that they provide excellent client service, but, unlike other attorneys, we practice what we preach.  We make sure every client walks away happy . . . period.

Comprehensive

We are your community law firm.  Our business is built on long-term relationships with our clients.  Our clients have the luxury of building trust over time with one team of attorneys, rather than having to find a new attorney for each different type of matter that arises over the course of their lives.  No one attorney can be experienced at everything.  That is why we have worked hard to assemble a team of attorneys with extensive experience in different areas of experience.  Our attorneys work together closely to bring our collective experience to bear on any issue that may arise for our clients.

Great at What We Do

Since our business comes entirely from referrals and community involvement, our reputation for quality legal work is our greatest asset . . . and it is extremely important to us.  Each of our attorneys is truly experienced in his or her practice areas, with the highest personal standards of excellence.  We are proud of our reputation in the community, and we did not achieve it by accident.  Our reputation for excellence comes from hard work, continuing education, and an above-and-beyond approach to our clients’ cases.
