Iowa Child Support Law Explained

In this episode, our Linn County family law attorneys explain child support law in Iowa for 2020. There are a couple of minor changes that have been approved for 2020.  The most notable change began on October 1st, 2019, at the beginning of the fiscal year.  Federal law now requires the Child Support Recovery Unit to deduct an annual fee of $35 from the family’s support payments.  The fee is withheld after the family has received $550 in support payments.  Exceptions and adjustments may be made, depending on the family’s circumstances.  For example, if the payee or any child of the payee has received cash assistance from Iowa or any other state, the fee will be waived.  If you have more than one child support obligation, the fee may be deducted from each case.

Iowa Child Custody Law Explained

In this video, our Linn County family law attorneys explain how Iowa Law requires that the court consider the best interests of the child and order​ a custody​ arrangement​ that will allow the child to maintain consistent physical and emotional contact with both parents whenever possible to encourage parents to share the rights and responsibilities of raising the child, so long as doing so will not cause physical or significant emotional harm to the children, other children, or either parent.  Custody is broken down into three parts: “joint legal custody,” “sole legal custody,” “physical placement.”

Family Law and Divorce Appeals in Iowa

In Iowa, all cases are originally heard by district trial courts. At the conclusion of a trial court case, a final decision is entered by the district court judge. In Iowa family law cases, these final decisions are called final decrees. A party who is dissatisfied with a decision made by the trial court may appeal the judge’s ruling to the Iowa Supreme Court. The Iowa Supreme Court then decides what cases it will hear and which it will remand back to the Iowa Court of Appeals
