Why O'Flaherty Law for My

Estate Planning

Matter?

In this video, Naperville estate planning attorney Kevin O'Flaherty describes why O'Flaherty Law is the best choice for your estate plan.

  • We Go Above-And-Beyond!  We are honored to have received the Avvo Client's Choice Award for Estate Planning.  Unlike other estate planning attorneys, we will not simply prepare forms and deliver them to you.  Rather, we take the time in your complimentary initial consultation to understand your goals and your financial picture and to fully educate you regarding the typical estate planning goals of individuals in your situation and how documents like trusts, wills, powers of attorney, and living wills can help you achieve those goals.
  • We Are Affordable!  We have been told by our clients that our pricing is well below the market rate.  We can afford to offer this because we practice many areas of law, and are not dependent solely on estate planning for the financial health of our firm.  We have the luxury of offering affordable estate plan pricing in order to a establish a long-term relationship with our clients and their families.   Why pay for an online form that is likely to be incorrect and defeat your goals, when for the same price you can get the experienced advice of a knowledgeable attorney who cares about you and your family?
  • We Know Our Stuff!  Many estate planning attorneys obtain a set of forms and do not take the time to understand them.  Estate Planning is one of the easiest areas of law to practice poorly.  Having the wrong attorney for your estate plan can lead to errors which will make the estate plan ineffective.  Our Naperville Estate Planning attorneys are experienced drafters, able to creatively tailor your documents to suit your needs.  We are also experienced in more complex aspects of estate planning that other attorneys do not take the time to understand, such as advanced estate tax avoidancecreditor avoidancespecial needs planning, and medicaid planning.
  • We are Comprehensive!  Estate planning often requires experience in other areas of law in which many sole practitioners lack experience.  We have a team of attorneys experienced in many areas of law that collaborate to craft inventive solutions for our clients.  If your estate plan requires experience in business representation, divorce & family law, immigration, probate or estate administration, or real estate transactions, our team of Naperville attorneys will work together to bring their knowledge to the table for you.  In addition, you may need an estate plan today, but require assistance with a different legal issue next year.  A long-term relationship with a full service law firm like O'Flaherty Law allows you to establish trust and avoid having to interview other attorneys for other legal issues that may arise in your life.

Five Documents In A Typical Estate Plan

In this article, our Naperville estate planning lawyers explain some of the common estate planning documents we use to acheive your goals:

  • Revocable Living Trust:  Keeps your estate out of a costly and time-consuming probate case, provides for distribution of assets and long-term specifications for how assets should be handled, and appoints fiduciaries to handle the distribution of assets.
  • Pour-Over Will: Names a guardian for minor children and allows the terms of your trust to control your probate estate should one become necessary.
  • Healthcare Power of Attorney:  Appoints a guardian of your person who will make healthcare and major life decisions for you should you become mentally incompetent, eliminating the need for a costly and time-consuming guardianship proceeding.
  • Financial Power of Attorney: Appoints an agent to make financial and legal decisions for you should you become mentally incompetent, eliminating the need for a costly and time-consuming guardianship proceeding.
  • Living Will: States your wishes in the event that you are in an irreversible coma, relieving the emotional burden on your loved ones.

In this article, our Naperville estate planning lawyers explain when revocable living trusts are appropriate in your estate plan. Revocable living trusts are appropriate for anyone who:

  1. Owns their home or other real estate (even if there is a mortgage); OR
  2. Has more than $100,000.00 of non-real estate assets; OR
  3. Wants to have long-term control of how their assets are handled after they pass, such as:

(a) divorcees who do not want their ex-spouses to gain control of assets intended for minor children; or

(b) families with children younger than 30 who do not want their children to have unfettered access to their inheritance before reaching an age where they will act responsibly.
