An estate accounting is a document made by an executor or administrator of an estate which contains all of a decedent’s assets and instructions for how those assets have been or will be distributed. An executor is typically named in the decedent’s will and approved by the court, as long as the representative is fit to serve as executor. In the absence of a will or nomination of an unfit candidate, the court will assign a representative to act as administrator for the case.

In this article, we explain the Illinois Trust Code and changes to Illinois trust and estate law for 2020. January 1, 2020 will mark the outset of the Illinois Trust Code or ITC, as it will be known. The Illinois Trust Code is an adaptation of the Uniform Trust Code UTC that has already been implemented in 33 states. Most of the new code is elective and can be modified or waived by the creator of the trust known as the settlor, but there are some parts of the new statutes than cannot be waived, such as the information a trustee must provide to beneficiaries.
