The court may make a distinction between guardianship of the person or guardian of the estate. This can be a difficult process. Our Davenport guardianship of a minor attorneys are here to ensure that your minor's rights are upheld and that appropriate guardianship is appointed.
The powers of a guardian of the person are very broad, but are subject to the review of the guardianship court. The guardianship court can override the guardian’s decisions if the court finds that they are not in the individual’s best interests.
In adult guardianship cases, the petitioner must serve the respondent with a summons at least 14 days prior to the guardianship hearing. The hearing must be held at least 30 days after the filing of the petition. Our Davenport attorneys explain this process in further detail and answer questions about what you need in order to file a petition.
