In this article, our Cook County guardianship lawyers explain the Cook County guardianship process. In Illinois, in order to be a guardian a guardianship proceeding must be filed with the appropriate circuit court.  Typically, guardianships may be granted by the court if your loved one is unable to communicate appropriate decisions regarding personal or financial matters. This can be due to a number of factors including: due to 

  • Mental illness
  • Age
  • Mental or physical disability; or 
  • Poor life choices such as "gambling, idleness, debauchery, or excessive use of intoxicants or drugs."  

To be named a guardian, you will be required to obtain an expert's report certifying that the guardianship is appropriate.  The report needs to be reviewed carefully to ensure that the expert's certifications are accurate, and the correct type of guardianship (limited or total/plenary guardianship) is recommended. 

This report is filed with the court along with the guardianship petition along with other supporting documents.  Once filed, it's served upon your impaired loved one along with a summons, notifying them of the guardianship hearing.  Our Cook County guardianship attorneys also send this notice to anyone living with your loved one and any other close family members. 

The court typically appoints a Guardian Ad Litem for the person that the guardianship is sought.  This is an attorney or other professional that will be responsible for protecting the best interests of the impaired individual throughout the proceedings. 

Guardianship hearings are typically held within 30 days after you filing ofthe guardianship petition, although it 's not unusual for this date to be delayed based on varying circumstances of your case.  The judge often requires that an expert or lay witness testify to the court regarding the condition of the impaired individual and we recommend having a witness present and ready to testify. 

If no problems or contesting exists, at the conclusion of the guardianship proceeding, the court issues an order appointing you to be your loved one's guardian.  After this happens, our Cook County guardianship attorneys assist you on an ongoing basis to prepare and file annual reports to the court regarding your administration of your loved one's estate. 

If your loved one is still mentally competent, one alternative to guardianship proceedings is thaving them execute aHealthcare and Financial Powers of Attorney, which explains the wishes of your loved one without the need of a court order. ​
