Under the Illinois Domestic Violence Act (IDVA), you may petition for an order of protection if you are a family or household member of the abuser. This includes: current or former spouses, individuals in a dating or engagement relationship (regardless of whether it is sexual), people who share or have shared a home, persons related by blood, marriage, or adoption, individuals who share a child in common, and people with disabilities and their personal assistants. The abuse does not need to be physical — it can include harassment, intimidation, interference with personal liberty, or willful deprivation. If you do not have a qualifying family or household relationship with the person harassing you, a stalking/no contact order may be the appropriate remedy instead.
Violating an order of protection in Illinois is a Class A misdemeanor, punishable by up to one year in jail and fines up to $2,500. A second or subsequent violation is elevated to a Class 4 felony, carrying 1–3 years in prison. The violation should be reported to police immediately — law enforcement can arrest the respondent without a warrant if they have probable cause to believe the order was violated.
