Yes. Under Illinois law (760 ILCS 3 — the Illinois Trust Code), a court can remove a trustee upon petition by a beneficiary, co-trustee, or the person who created the trust. Grounds for removal include: serious breach of trust; inability or unwillingness to administer the trust effectively; persistent lack of cooperation among co-trustees; the trustee acting in a manner that is not in the best interests of the beneficiaries; or a long-term deterioration in the trustee-beneficiary relationship that makes effective administration impractical. The court considers whether removal serves the purposes of the trust and the beneficiaries' interests. A removed trustee may also be ordered to account for and restore any losses caused by their misconduct. Illinois trust litigation deadlines vary depending on the type of claim. Under the Illinois Trust Code, a beneficiary who receives a trustee's account or report generally has 1 year from that disclosure to bring a claim based on information disclosed in the report (or 5 years if material facts were not disclosed).
