​In order to maintain a claim for intentional infliction of emotional distress (IIED), you must show:

  1. that the conduct of the defendant was extreme and outrageous;
  2.  that the defendant intended to cause you severe emotional distress or knew that there was a high probability that his conduct would cause such distress; and
  3. That the defendant’s conduct did in fact cause you severe emotional distress.

What qualifies as extreme and outrageous conduct? First, let’s take a closer look at the first element, “extreme and outrageous” conduct.  Conduct is extreme and outrageous if it goes beyond the bounds of decency.  It must be more than mere insults, indignities, or threats. When deciding whether conduct is extreme and outrageous, courts will look at all the facts of the case and make a determination on a case by case basis.

In this article, you can expect to gain insight from our criminal attorneys about what to do in the event that you have been arrested for a DUI.  When you contact our attorneys regarding a case of DUI, we will negotiate a plea with the state to support you in the dismissal or reduction of charges. 

In certain cases, a plea may not be available.  If a plea is not available in your case, we will go through the necessary steps to award you court supervision.  By receiving court supervision, you avoid having a conviction on your record and you get your license back.  Some steps you can expect to go through to be awarded court supervision are paying a monetary fine, undergoing an alcohol evaluation, and participating in a Victim Impact Panel.  In some cases, community service may also be required.  Upon the completion of your supervision requirements, your case will be dismissed and you will not have a conviction on your record.  The process for supervision and dismissal typically takes around 12 months.

Statutory Summary Suspension Of Your License

Winnebago County DUI Attorney, Winnebago County Traffic Attorney, Winnebago County Criminal Attorney, Winnebago County Criminal Lawyer, Winnebago County Traffic Lawyer, Winnebago County DUI Lawyer, Winnebago County Expungement Attorneys

Our DUI, traffic, and criminal attorneys explain different ways your license can be suspended when faced with a DUI and the length of time each specific suspension will last.  Refusing a breathalyzer for your first DUI will result in an automatic one-year suspension.  A breathalyzer reading a BAC higher than .08 will also result in an automatic license suspension, but this suspension will last 6 months. 

You are still entitled to a hearing even if your license is suspended.  If you fail to file a Petition for Hearing within 90 days of your arrest, your right to a hearing will be waived.  Within 30 days of the filing date you will receive a hearing. 

In your hearing you can expect to be asked the questions: Did the officer have probable cause to pull you over? Was a proper arrest made? Did you receive the proper legally required statutory summary suspension warnings? Did you actually fail the breathalyzer?
