A child's wishes can be one factor considered by an Illinois court, but the child does not automatically get to decide where to live. The court looks at the child's maturity and ability to express an independent preference along with many other factors affecting the child's best interests. The importance given to the child's preference can vary depending on the circumstances.
If a court-ordered parenting plan is repeatedly being violated, it may be possible to ask the court to enforce the order. Keeping records of missed exchanges, denied parenting time, messages, and other incidents can be helpful. Depending on the circumstances, a parent may also seek changes to the parenting arrangement when ongoing problems make the existing plan unworkable.
A parenting plan can address much more than where the child stays during the week. It may establish regular parenting time, holidays, vacations, transportation, communication between parents, decision-making responsibilities, and procedures for resolving future disagreements. A detailed plan can reduce confusion and provide both parents with clearer expectations as circumstances change.
