Illinois Adoption Law Explained

In this article, our Illinois adoption attorneys explain adoptions in Illinois under the Illinois Adoption Act. We discuss in detail different types of adoption, including:

In order to be eligible to adopt in Illinois you must not have a legal disability, have lived in Illinois for at least 6 months, and have a good reputation. 

People who can be adopted included children who have been surrendered to an adoption agency, children who have been placed in the custody of the prospective adoptive parents by the biological parents, children whose adoption has been consented to by a court-appointed authority, and adults who have resided with the prospective adoptive parents for more than 2 years.

Adoption in Illinois is initiated by filing an adoption petition in the appropriate circuit court.  We explain where to file the adoption petition, which documents must accompany it, the filing deadline, and notice and service requirements. We also explain what to expect at an interim order hearing to decide who will have temporary parental responsibilities for the child during, and how to navigate the final hearing, obtaining a judgment for adoption, and acquiring a revised birth certificate.
