Employees can view and access their personnel records twice a year while employed and up to a year after termination. They also can access their employer's personnel records as long as they pay copying fees.
In Illinois there's no law requiring an employer to create personnel files for employees and an employee may only review records if they exist. Employers must retain any and all documentation to support termination in that employees' personnel file, otherwise it becomes inadmissible in court as evidence in any future litigation.
We discuss an employer's duty to pay the full amount that has been worked to an employee that is terminated during the next payroll period. An employee that is withheld payments is due the wages, but also attorney fees and 2% a month for every month wages have been withheld due to the Illinois Wage Payment and Collection Act.
