The first step in reviewing a commercial lease or commercial real estate contract is for our attorneys to prepare a bullet-point opinion letter bringing to your attention potential negotiating points or issues with your contract. We will then go through the letter with you in person or by phone to determine which issues are important to you.  Then you can either have us draft proposed changes to the contract to present to the other party, or you can simply provide our opinion letter to the other party to determine their position.  We find this process to be cost-effective, because we determine which issues are important to each side and are worth spending time to negotiate before performing a significant amount of legal work.

These may include a share of taxes, utilities and common maintenance charges. The additional rent will change from year to year. If you believe your landlord is overcharging you, the best solution is to audit the landlord's expenses and verify that the common maintenance charges are being charged at market value, as opposed to an inflated price because of either a sweetheart deal or landlord embezzlement. For this reason, it is imperative that your lease include a clause that gives you the right to audit the landlords’ records. If your lease does not include this clause the landlord is not required to provide records.​
